Terms of Service

1. Acceptance of Terms

By accessing or using Chatchatty ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Eligibility

You must be at least 13 years old to use our Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Account Registration

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account
  • You must notify us immediately of any unauthorized use of your account
  • You may not use another person's account without permission

4. User Content

You retain ownership of content you post on Chatchatty. By posting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, display, and distribute your content in connection with the Service.

You agree not to post content that:

  • Is illegal, harmful, or offensive
  • Infringes on intellectual property rights
  • Contains malware or harmful code
  • Is spam or misleading
  • Harasses, threatens, or bullies others
  • Contains hate speech or discrimination
  • Violates others' privacy

5. Community Guidelines

Users must follow our Community Guidelines when using the Service. Violations may result in content removal, account suspension, or permanent ban.

6. Intellectual Property

The Service and its original content (excluding user content), features, and functionality are owned by Chatchatty and are protected by international copyright, trademark, and other intellectual property laws.

7. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CHATCHATTY'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO CHATCHATTY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED POUNDS STERLING (£100).

IN NO EVENT SHALL CHATCHATTY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF YOUR USE OF THE SERVICE.

NOTHING IN THESE TERMS SHALL LIMIT OR EXCLUDE OUR LIABILITY FOR: (A) DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE; (B) FRAUD OR FRAUDULENT MISREPRESENTATION; OR (C) ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED BY APPLICABLE LAW.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

11. Dispute Resolution

Before initiating formal legal proceedings, you agree to first contact us at support@chatchatty.com and attempt to resolve the dispute informally. If the dispute cannot be resolved within thirty (30) days, either party may pursue their claims in accordance with §10.

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND CHATCHATTY AGREE THAT ANY PROCEEDINGS TO RESOLVE OR LITIGATE ANY DISPUTE WILL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS, AND THAT YOU WILL NOT SEEK TO HAVE ANY DISPUTE HEARD AS A CLASS ACTION, A REPRESENTATIVE ACTION, A COLLECTIVE ACTION, A PRIVATE ATTORNEY-GENERAL ACTION, OR IN ANY PROCEEDING IN WHICH YOU ACT OR PROPOSE TO ACT IN A REPRESENTATIVE CAPACITY ("Class Action Waiver").

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.
